How to raise jurisdictional objections?

date:2019/11/26 Clicks:100
Jurisdictional objection refers to the claim that the court has no jurisdiction over the case.
According to Civil Procedure Law of the People's Republic of China, If a party to an action objects to the jurisdiction of a people's court after the court has entertained the case, the party must raise the objection within the period prescribed for the submission of defence. That is, the jurisdictional objection shall be raised within 15 days after receipt of the copy of the complaint from the court. The people's court shall examine the objection. If the objection is established, the people's court shall order the case to be transferred to the people's court that has jurisdiction over it; if not, the people's court shall reject it.
If the party is not satisfied with the rejection of jurisdictional objection of the ruling, the party may appeal to the people's court at the next higher level.
